This Privacy Policy should be read together with our Terms and Conditions and any specific privacy notice, consent wording or collection notice shown when information is collected.
1. What is personal information?
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.
Depending on how you interact with Breaktime, this may include your name, phone number, email address, business details, communication history, enquiry information, billing information, online identifiers and other information connected with you.

- information generated through cookies, analytics, advertising pixels and similar technologies;
- publicly available business contact information; and
- any other information reasonably required to provide or improve the service you request.
We try not to collect information that is unnecessary for the relevant purpose.
3. Sensitive information
Breaktime's standard services are not designed to collect sensitive information unless it is genuinely necessary.
Sensitive information can include information about health, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, criminal records and certain other protected matters.
If sensitive information is required, we will handle it only where permitted by law, including where consent has been obtained where required.
People sometimes provide information we did not request through free-text forms, calls, messages or Enquiry Assistant conversations. Please avoid sending sensitive information unless it is relevant and necessary.
Standard Breaktime services are not intended to operate as specialised systems for high-risk or regulated sensitive-information workflows unless this has been separately assessed and agreed.

- book a meeting;

We may also collect information from:
- a Breaktime client where we are providing services on that client's behalf;
- authorised employees, contractors or representatives of a business;
- referrals and business partners;
- publicly available business websites and directories;
- publicly available social media or Google Business information;
- connected social, messaging, advertising or communications platforms;
- analytics and website technology;
- payment processors;
- telephony and messaging providers; and
- other service providers used to operate Breaktime.
Where practical and appropriate, we collect personal information directly from the individual concerned.
5. Publicly available business information and prospecting
Breaktime may use publicly available business information to understand a business, identify potential service fit or make business-to-business contact.
This may include information published on:
- a business website;
- Google Business;
- business directories;
- professional directories;
- public social media profiles and pages; or
- other legitimate public business sources.
We do not treat the fact that information is publicly available as permission to use it without limit.
Any marketing or outreach using personal information remains subject to applicable Australian privacy, spam and telemarketing laws and opt-out requirements.
6. Why we collect and use personal information
We may collect, hold, use and disclose personal information for purposes including:
- responding to enquiries;
- providing requested reports or information;

- maintaining business and accounting records; and
- sending marketing where permitted by law and consistent with your consent or reasonable expectations.
We may also use information in de-identified or aggregated form for analytics, service improvement and internal planning where the information no longer identifies an individual.
7. Revenue Leak Review and Business Loss Report
If you complete a Revenue Leak Review, we may use your answers, business information and other relevant information to analyse areas such as enquiry handling, online visibility, follow-up and sales or marketing gaps.
We may combine information you provide with relevant industry benchmarks or other supporting information to prepare a Business Loss Report.
The Business Loss Report may include an indicative estimate of potential revenue at risk. This is not confirmed financial loss and is not a guarantee of revenue that Breaktime will recover.
Information collected through the Revenue Leak Review may also be used to:
- deliver the report you requested;
- recommend a Breaktime plan;
- respond to questions;
- provide operational follow-up relating to the report; and
- send marketing communications only where permitted and where the relevant consent or other lawful basis exists.
We maintain separate consent records for relevant marketing channels where practical.
8. Enquiry Assistant and AI-assisted tools
Breaktime uses AI-assisted tools and automated workflows as part of delivering some services.
Depending on the context, these tools may help to:
- respond to common questions;
- summarise or classify enquiries;
- recommend a Breaktime plan;
- collect qualification information;
- provide approved business information;
- assist with bookings, forms or signup steps;
- generate or support parts of a Business Loss Report;
- prepare content or draft communications;
- route a conversation to the appropriate person; and
- identify where human review or follow-up is required.
The Enquiry Assistant works from approved information and defined rules. Human handover is part of the service design where judgement, unusual circumstances, complaints, sensitive matters or information outside the approved scope are involved.
AI-assisted outputs can sometimes be incorrect or incomplete. Breaktime uses reasonable testing, review and handover controls, but automated systems should not be treated as infallible.
If you would prefer to deal with a person, you may request human assistance.
We do not use AI-assisted tools as a substitute for legal, financial, medical or other regulated professional advice.
9. Personal information we process for Breaktime clients
Breaktime may operate websites, forms, communication workflows, enquiry handling, social messaging, booking processes or other systems on behalf of a Breaktime client.
In those circumstances, personal information may relate to that client's prospective or existing customers.
The Breaktime client generally determines why that information is collected and how it is used for the client's business. Breaktime handles the information to provide the agreed service to that client.
Where appropriate, enquiries about a client's use of your information should be directed to that client.
Breaktime clients remain responsible for their own legal obligations concerning the personal information of their customers, including appropriate privacy notices, permissions and lawful marketing practices.
10. Payments
Payments may be processed through third-party payment providers such as Stripe and payment functionality integrated with our service platforms.
Breaktime does not ordinarily receive or store your complete payment card number.
We may receive and retain information such as:
- billing name and contact information;
- payment status;
- transaction amount;
- transaction date;
- subscription status;
- payment method type; and
- limited payment identifiers supplied by the payment provider.
Payment providers handle payment information under their own privacy and security terms.
11. Cookies, analytics and tracking technologies
Our websites and funnels may use cookies, pixels, analytics tools and similar technologies.
These technologies may collect information about:
- pages visited;
- buttons or links selected;
- referral sources;
- approximate location derived from technical information;
- device and browser type;
- session activity; and
- interactions with marketing campaigns.
We may use this information to:
- operate the website;
- understand how visitors use our pages;
- improve website and funnel performance;
- measure advertising and marketing;
- identify technical problems; and
- improve customer experience.
You can usually control cookies through your browser settings. Blocking some cookies may affect website functionality.
12. Direct marketing
Where permitted by law, Breaktime may send marketing communications by email, SMS, phone or other supported channels.
We may use personal information for direct marketing where you have consented, where you would reasonably expect us to do so and the law permits it, or another lawful basis applies.
Marketing communications will provide a reasonable way to opt out.
You can ask us to stop sending direct marketing at any time.
For email, use the unsubscribe option where provided or contact us.
For SMS marketing, you may use the opt-out method stated in the message, such as replying STOP, where available.
Opting out of marketing does not prevent us from sending necessary service, billing, support, security or transactional communications relating to something you requested or purchased.
13. When we disclose personal information
We may disclose personal information where reasonably necessary to:
- provide a service you requested;
- operate our website, CRM and communications systems;
- process payments;
- deliver email, SMS or telephone communications;
- operate the Enquiry Assistant or other AI-assisted functionality;
- host or store information;
- provide analytics, security and technical support;
- use approved contractors or suppliers;
- manage professional advice, accounting or legal requirements;
- respond to a lawful request from a regulator, court or government authority;
- protect our legal rights or the safety of people or systems; or
- complete a genuine business sale, restructure or transfer where appropriate protections apply.
We do not sell personal information as a standalone data product.
14. Service providers and technology platforms
Breaktime relies on external service providers to deliver its services.
These may include providers for:
- customer relationship management;
- website hosting;
- email;
- SMS and telephony;
- payment processing;
- cloud storage;
- analytics;
- social media;
- appointment scheduling;
- AI-assisted processing;
- automation; and
- professional support.
Current or likely providers may include GoHighLevel, Stripe, Google services, social media platforms and AI service providers such as OpenAI where relevant to the service.
The particular providers used may change as our systems evolve.
We select and configure providers with regard to functionality, security, reliability and the needs of the service, but independent providers operate under their own terms, infrastructure and security practices.
15. Overseas processing and disclosure
Some of our service providers operate internationally or store, process or support information outside Australia.
As a result, personal information may be processed or disclosed overseas.
Countries may vary depending on the provider and service used, but are likely to include the United States of America, and may include other countries in which our service providers, infrastructure providers or their subcontractors operate.
Where Australian privacy law requires us to take steps in relation to overseas disclosures, we will take reasonable steps appropriate to the circumstances.
Because cloud and technology providers may change infrastructure, backup locations and subprocessors over time, it may not always be practicable to identify every country in which information is processed.
16. Data security
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.
Depending on the system, measures may include:
- controlled access;
- account authentication;
- role-based permissions;
- reputable service providers;
- secure payment processing;
- system monitoring;
- backups;
- staff or contractor access controls; and
- procedures for handling incidents and correcting errors.
No internet, cloud or communications system is completely secure. We cannot guarantee absolute security.
If a data incident occurs, we will assess and respond to it. Where the Notifiable Data Breaches scheme or another legal notification requirement applies, we will follow the applicable assessment and notification requirements.
17. Keeping information accurate
We take reasonable steps to keep personal information accurate, current and complete where it is used for an important business purpose.
You can help by telling us when your information changes.
Breaktime clients using our managed systems are responsible for providing and approving accurate business information, including prices, services, policies, service areas and contact information.
18. How long we keep personal information
We retain personal information for as long as reasonably necessary for the purpose for which it was collected and for legitimate business, legal, accounting, security, dispute-resolution and record-keeping purposes.
Retention periods may vary depending on:
- the type of information;
- whether there is an active customer relationship;
- legal and accounting requirements;
- dispute or complaint requirements;
- fraud and security needs; and
- the operation of backups and third-party systems.
When personal information is no longer reasonably required, we will take reasonable steps to delete, destroy or de-identify it where appropriate and practicable.
Some information may remain in backups or archived systems for a limited period after deletion from active systems.
19. Accessing your personal information
You may contact us to request access to personal information we hold about you.
We may need to verify your identity before providing access.
There may be circumstances where we are permitted or required by law to refuse access or provide only limited access. If that occurs, we will explain the reason where required and appropriate.
20. Correcting your personal information
If you believe personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you can ask us to correct it.
We will take reasonable steps to consider and action valid correction requests.
21. Deletion requests
You may ask us to delete personal information we hold about you.
We will consider the request and delete or de-identify information where reasonably appropriate and legally permitted.
We may need to retain some information where required or reasonably necessary for:
- legal obligations;
- accounting and transaction records;
- fraud prevention;
- security;
- dispute resolution;
- enforcing agreements; or
- establishing, exercising or defending legal claims.
22. Anonymity and pseudonyms
Where it is practical, you may interact with us without identifying yourself or by using a pseudonym.
In many situations, however, we need accurate identifying or contact information to provide a report, respond to an enquiry, process payment, manage an account or deliver a service.
23. Children
Breaktime's services are intended for businesses and adults acting for businesses.
Our services are not directed to children.
If we become aware that we have collected personal information from a child in circumstances where we should not hold it, we will take reasonable steps to address the situation.
24. Links and third-party websites
Our websites, reports or communications may contain links to third-party websites, social platforms or services.
Those third parties control their own privacy practices.
Breaktime is not responsible for the privacy practices of an independent third-party website merely because we provide a link to it.
25. Privacy complaints
